Getting REPLACEMENT TITLES for a manufactured home in Georgia

I recently encountered an issue with obtaining replacement titles for a property we purchased about a month ago. The previous owner had bought the house in 2019 and had a mortgage on it. Despite believing that the titles had been retired, it turned out that the title company handling the 2019 closing did not properly retire the titles. As a result, we had to address and rectify this issue.

One of the things we had to do was to get replacement titles for the mobile home or the manufactured home. We reached out to the previous owner, the person from whom the seller bought it, found him, and got him to sign a power of attorney to transfer the titles to us. Once I got the replacement titles, I signed them over to myself, effectively bypassing the seller from whom we bought the land. Importance Of Replacement Titles

Let’s talk about how to get replacement titles and why they may be needed.

If you haven’t properly retired the titles, and you plan to sell the property, you will need those titles. If you can’t find them, you’ll need replacement titles to complete the sale. Similar to a car, a double-wide mobile home has two titles – one for side A and one for side B. A single-wide only has one title. To get replacement titles in your name, you will need to fill out the MV-1 form. The MV-1 form is the Georgia Department of Revenue Motor Vehicle Form MV-1, used to get replacement titles for your mobile or manufactured home. This form is also used to obtain a car title. If you are transferring the title from a seller to a buyer, the buyer will also use this form to put the titles in their name.

11. Please provide the number of owners. If there is more than one owner, indicate the correct number. If there is only one owner, just put a “1” and indicate that there is only one owner. For the owner’s name, please enter the name of the current owner as it appears on the title. If you are unsure of the current owner’s name, this could cause some issues. If you believe you are the owner but find that the property is registered under someone else’s name, you will need to contact that person to complete the form.

Power Of Attorney

To authorize someone else to handle matters related to your manufactured home, you can use a power of attorney form available on the Georgia Department of Revenue website.

  • You will need to ensure that the current owner signs the form and gets it notarized.
  • If you own a double wide, you will need a separate form for each side.
  • If you have a triple wide, you will need three forms.
  • When filling out the form, provide the full name, date of birth, email address, driver’s license number, and state of the owner.
  • If there is no business name, use the home address as the address. Additionally, include a mailing address if it’s different.
  • The form must be signed by the owner, or by the person granted power of attorney. If there are two owners, both owners’ information should be included.

Dealing With Liens

Please take note of the following information:

  • You do not need lessee information, security, or lien holder details for replacement titles if there is a lien on the vehicle.
  • In such cases, the lien must be satisfied or the lien holder’s information should be provided, and you will need to reach out to the lien holder.
  • The bank or lender holds the titles until the lien is paid off.
  • If there is attorney in fact information, you should provide the power of attorney details in the designated space, including your name, mailing address, and phone number.
  • Make sure to follow the instructions provided.
  • You can apply for replacement titles at the local county tax assessor or tag office where the home is located.
  • Remember to do this in the county where the home is located, not in your own county.
  • If you’re told otherwise, kindly let them know that they are wrong.

At the county office, they will submit this information to the Georgia Department of Revenue. In a couple of weeks (although this video was made in early 2024, and there may be delays due to issues with mail distribution by the US Postal Service in the Atlanta area), you will receive a blue envelope in the mail with the new titles. If it’s a double wide, you will receive the titles in separate envelopes. The blue envelope containing your new titles will be sent to you by the Georgia Department of Revenue within a couple of weeks.

If you want to sell your manufacture home, here’s what you need to do:

1. Sign the back of the title on the transfer signature and transferor’s name in the red part.

2. Give the signed titles to the buyer.

3. The buyer will fill out the top section of the title and another MV-1 form, and then get the titles transferred into their name.

If you need the titles urgently, you can go to the Welcome All Road Tag Office located off Camp Creek Parkway in Atlanta near Hartsfield Airport.

Here are the directions:

1. Take Camp Creek Parkway heading east, away from the airport.

2. Turn left at Welcome All Road Connector, which is the third or fourth traffic light.

3. Take the next left and follow the signs.

4. After driving less than a mile, you will find the Welcome All Road Tag Office on the right in an office park.

5. Look for the sign for the Georgia Department of Revenue and turn into the building.

Supplementary Information

  • You can obtain same-day replacement titles for mobile homes and cars from the office. However, you cannot transfer mobile home titles at that location.
  • If you need a replacement title, you can request and receive a same-day replacement at the office by bringing the necessary forms.
  • If you have power of attorney, you must bring a copy of the owner’s ID along with your own ID, as well as your driver’s license.
  • Before heading to the office, ensure that there are no outstanding liens on the title, as replacement titles cannot be issued if there are outstanding liens. Contact your local county to confirm the status of any outstanding liens.
  • If there are no liens, you should be able to receive the replacement titles the same day.
  • If there are liens on the title, you will have to address that issue separately.
  • If you have replacement titles, then you can proceed. You have the option to retire them.
  • If there’s a pending sale, it’s not recommended to retire the titles now. It can take up to six weeks to complete the process and receive a confirmation.
  • If you need to make a sale immediately, you can sign the back of the titles and transfer ownership to the buyer.
  • If the buyer is obtaining a mortgage and the lender requires the titles to be retired, you, as the seller, may have to pay the cost to have the titles retired through a title company or closing attorney.
  • If your current closing attorney doesn’t know how to handle a specific procedure, it might be best to find a different one. Most closing attorneys are familiar with the process and should be able to handle it properly. I have another video that discusses retiring titles, which is something you can do on your own.
  • If you prefer to have the attorney’s office take care of it for you, they are capable of doing so. In the past, I have facilitated the replacement of titles in many closings, where we signed them over to the buyers and then had the attorney’s office retire them for us. They did charge us a fee, amounting to several hundred dollars, but it was worth it because time is often crucial in these deals.
